Act on accessibility requirements for products and services (Lov om tilgængelighedskrav for produkter og tjenester), Denmark’s digital accessibility regulation, is governed by the Danish Agency for Digital Government.
What it includes
The Act promotes inclusivity across sectors and equal access for all users, regardless of the medium or platform and includes:
- General purpose consumer computer hardware systems and operating systems for the purposes of the hardware systems in question
- Payment terminals
- ATMs
- Ticket machines
- Self-service machines for check-in
- Interactive self-service terminals providing information, except for terminals installed as an integral part of vehicles, aircraft, ships or rolling stock
- Consumer terminal equipment with interactive data processing capability used for electronic communications services
- Consumer terminal equipment with interactive computing capability used to access audiovisual media services
- E-readers
- Electronic communication services other than transmission services used for communication between machines
- Services providing access to audiovisual media services
- The following elements of passenger transport by plane, bus, train and ship, except for transport services in cities and suburbs and regional transport services, for which only the elements in letter e apply:
- Websites
- Services for mobile devices, including mobile applications
- Electronic tickets and electronic ticket services
- Provision of information about transport services, including travel information in real time This is limited, as far as information screens are concerned, to interactive screens on the territory of the European Union
- Interactive self-service terminals in the territory of the European Union, except those installed as integral parts of vehicles, aircraft, ships and rolling stock used for the provision of any part of this passenger transport
- Consumer-oriented banking services
- E-books and dedicated software
- E-commerce services
Exceptions
- Pre-recorded time-dependent media published before June 28, 2025
- Document formats published before 28 June 2025
- Online maps and mapping services, when essential information is provided in an accessible digital way, in the case of maps intended for navigational use
- Third-party content that is neither funded nor developed by or under the control of the trader in question
- Content on websites and in applications for mobile devices that qualify as archives, meaning they only have content that has not been updated or edited after June 28, 2025
Fines and penalties
Penalties aim to uphold standards and incentivize adherence to accessibility requirements across industries. Under this Act, those who breach the established regulations may be subject to a fine as a penalty, although no amount has been specified as of this writing. Additionally, legal entities such as companies may be held criminally liable.
Reporting
Denmark follows the EU-wide mandate for accessibility statements on public sector websites and digital services. These accessibility statements are essential for maintaining transparency and accountability.
Public and private sector bodies must create an accessibility statement for their websites and mobile apps, summarizing their current compliance status according to the Web Content Accessibility Guidelines (WCAG). This includes noting any inaccessible components and explaining the reasons or providing timelines for expected improvements. Accessibility statements must be updated regularly, detailing specific measures taken to ensure ongoing compliance and identifying any remaining issues.
