This Privacy Policy was adopted by the Company and entered into force on Jan 1st 2024.
This privacy policy describes how The Company collects, uses, processes, and protects the information that the Clients provide in connection with the creation of their profile and the use of the Company’s products and services.
Information that the Company collects:
Information about the Client’s profile: When creating a Client’s profile (regulated in item 4 of the General Terms and Conditions), the Client provides information such as its name, e-mail address and password, which it fills in a registration form located on the Company’s website, located at https://qualibooth.com. When the Client logs into its account through its Microsoft or Google account, the Company accesses and collects information about the Client’s name, address, profile picture, and language preferences.
Product and service usage data: The Company collects information about how the Clients use the products and services provided by the Company and how the Clients interact with the Company’s products and services. In addition, the Company is collecting and processing information about:
- Log files
- IP addresses
- Browser types
- Viewed pages
- Dates of access and installation of the products and services (including the date of installation of the script (browser script))
- Internet pages included in the Client’s profile
- Dates on which error reports (described in item 2 of the General Terms and Conditions) were generated for these pages, including the content of the reports
- All data exchanged between the software, the script (browser script) and the program code of the Company’s products and services and the Client’s Internet pages. This includes, but is not limited to, information such as the number and types of errors and inconsistencies, addresses and names of websites, consumption, number of logins by the Client, products and services used by the Client, and more.
- The Client’s viewing of videos, instructions and other training materials on how the products and services can be successfully installed and used.
Payment information: The Company collects and processes the necessary information for payment of the subscription fees owed by the Clients and other amounts owed by the Clients, as well as information necessary for billing purposes. The Client provides the Company with data such as:
- Company information
- Country in which the Client is registered
- Address of management
- Number, month and year of validity of a credit card
- Security code of a credit card
- Telephone number
- VAT number
- Other information necessary for carrying out payments and invoicing.
Data on current and past subscriptions, promotional plans and free trial periods: The Company collects information about the products and services used by the Client, including data on current and past subscriptions for priducts and services, promotional and introductory plans, and free trial periods that the Client has used.
Data Storage Location: All data collected by QualiBooth is securely stored on servers located in Frankfurt, Germany. This ensures that all data remains within the European Union (EU) and complies with EU data protection regulations.
How the Company uses the Clients’ information:
The Company uses Clients’ information for a variety of purposes, including:
- Creating and Managing Client Profiles: Client information is used to create and maintain profiles for Clients.
- Providing and Maintaining Products and Services: Client data is used to provide and ensure the functionality and rendering of the Company’s products and services.
- Product and Service Improvement: Information is utilized to make changes to the characteristics and parameters of the offered products and services, as well as to enhance their quality and functionality.
- Introducing New Products and Services: Client data may be used to introduce and offer new products and services to Clients.
- Transaction Processing: Data is processed to handle transactions, including billing, and to send and store messages and documents related to transactions, billing and invoicing.
- Billing and Payments: Client information is used for charging credit cards and payment methods for subscription fees, payments, and amounts owed to the Company.
- Automatic Subscription Renewal: The Company may use Client data to initiate the automatic renewal of a Client ‘s subscription plan upon its expiration, as per the General Terms and Conditions.
- Client Support: Information is utilized to answer inquiries, provide assistance to Clients regarding product and service installation and usage, and clarify the parameters of offered products and services, including different subscription plans.
- Communication: Client data may be used to send emails, messages in the Client profile, phone notifications, and other forms of communication about updates, promotional offers, new products and services, or other relevant information.
- Internal Marketing: Data is employed for internal marketing purposes, including sending emails and messages to Clients with links to videos, instructions, training materials, offers for additional services, upgrades to higher subscriptions, promotional offers, discounts, and more.
- Limiting Free Trial Access: Client information may be used to limit a Client ‘s ability to use a free trial period (in accordance with the provisions of the General Terms and Conditions, if the Client has ever used a free trial period for any service or product, the Client shall not be entitled to receive another free trial period).
- No Data Redistribution: Qualibooth guarantees that all data collected is not redistributed or resold to any third-party vendors. We prioritize your privacy and ensure that your data is used solely for the purposes outlined in this policy.
These uses of Client information are essential for the Company to provide its products and services effectively, communicate with Clients, and improve its offerings. The Company also ensures compliance with data protection regulations and respects Client privacy.
Security of information:
The Company employs prudent measures to safeguard Client information, encompassing encryption, secure socket layer technology, and routine internal audits and security assessments. The Company engages the services of Payment Providers that adhere to the Payment Card Industry Data Security Standard (PCI DSS), ensuring compliance with this recognized standard. The Company refrains from handling or retaining credit card numbers and security codes belonging to Clients; instead, these particulars are managed and processed by Payment Providers for payment transactions.
Cookies and Tracking Technologies:
The Company utilizes cookies and analogous technologies to enhance the experience of Clients and other users of the Company’s website. These technologies are employed to analyze usage patterns and deliver relevant content.
- The cookies and tracking technologies employed by the Company on its website can be categorized into five primary types:
- Strictly necessary cookies: These are cookies that are essential for the proper functioning of the website and the provision of fundamental services. They serve critical functions such as enabling navigation between individual pages of the website, accessing secure areas, and remembering user preferences within a single session or across repeated visits.
- Long-term (persistent) cookies: These are cookies that remain stored on the Client’s (user’s) device for an extended period and are not deleted when the browser is closed. Persistent cookies serve various purposes, including remembering the Client’s (user’s) preferences such as language and regional settings, retaining login information for the “user profile” to avoid the need for repeated username and password entry, analyzing Client behavior, including services used, time and duration of usage, visited website pages, personalizing advertisements, and displaying targeted advertisements and offers based on Client behavior and preferences.
- Statistical (analytical) cookies: These cookies are employed to gather information about how the Clients and the users engage with the Company’s website. While the information about the Company’s Clients is not anonymous, these cookies provide anonymous data to the Company regarding the other users interactions and access of the website. Such cookies track metrics such as the number of visits to the website, including unique visits, traffic sources (e.g., direct access, search engine referrals, referrals from other websites), and dwell time (cookies record the most visited pages and the duration of time visitors spend on each page).
- Marketing cookies: These cookies are employed to monitor the way Clients and users utilize the Company’s website, services, and products for the purpose of delivering personalized advertisements and offers. They are used to send advertisements and offers that are tailored to the individual user and/or Client based on their preferences and interests. All Clients of the Company provide consent to receive commercial messages, as per the provisions of Article 15 of the General terms and conditions, and this consent can be revoked at any time.
- Security cookies: These cookies are utilized to monitor and prevent fraudulent activities and abuse.
By accepting this Privacy Policy, the Clients provide their consent to the Company’s use of the tracking and cookie technologies described above, including strictly necessary, long-term, statistical, marketing, and security cookies.
Services from third parties – suppliers:
The Company may engage third-party suppliers for various business-related functions, including analysis and payment processing. This may involve utilizing services provided by Payment Providers such as Stripe (https://stripe.com/en-bg), Recurly (https://recurly.com), and others for accepting and processing payments. Clients agree to the utilization of such Providers and also agree to adhere to the terms and conditions set forth by those providers, including privacy policies and terms of service.
Clients are required to furnish the Providers with their pertinent details, including company information, country of registration, address of management, credit card details (such as card number, expiration month and year, and security code), telephone number, VAT number, and any other data that may be necessary for payment processing, invoicing, and the generation and retention of relevant documents associated with payments. It should be noted that Payment Providers are responsible for the processing and storage of Clients’ credit card numbers and security codes.
The Client’s right to choose which data to provide:
Clients are entitled to the following rights:
- Clients have the right to update their profile information at any time.
- Clients have the right to request the deletion of their user profiles by sending a request to support@qualibooth.com
- Clients have the right to request the deletion of their user profiles by sending a request to support@qualibooth.com
- Clients can disable cookies in their browser settings, with the exception of cookies that are technically necessary for providing the products and services and for accessing the Company’s website.
Applicable Law and Jurisdiction:
The collection, use, processing, and storage of information provided by the Clients in connection with the use of the Company’s products and services is governed by the laws of the Republic of Bulgaria.
Any disputes that arise between the parties will first be subject to negotiations with the intention of reaching an amicable resolution. If the parties are unable to reach an agreement through negotiations, the dispute may be brought before the appropriate Bulgarian court, which includes the Sofia District Court or Sofia City Court.
Amendment of this Privacy Policy:
The Company reserves the right, at its discretion, to modify this Privacy Policy at any time. Any changes to the Privacy Policy will be communicated to the Clients at least 7 days before they come into effect by publishing the updated Privacy Policy on the Company’s website. Clients are responsible for regularly reviewing any changes to the Privacy Policy on the Company’s website and understanding these changes. If a Client continues to use the products and services after the revised Privacy Policy comes into effect, it will be considered as acceptance of and shall be considered as a consent by the Client to be bound by the updated terms.
The Company may choose to announce changes to the Privacy Policy on its website, within the Client’s profile, or through other suitable means, including sending notifications to the Client’s email. Regardless of the method used, Clients will be considered adequately informed of the Privacy Policy changes as long as the changes are published on the Company’s website or communicated through any of the provided notification methods, and it will not be necessary to provide notice through two or multiple means.
If the Client disagrees with the changes in the Privacy Policy, it has the right to terminate the agreement by providing written notice to the Company before the amended Privacy Policy takes effect. In such a case, the agreement will be terminated upon the expiration of the subscription period and until then the Privacy Policy that was in force prior to the changes will apply to this specific Client.
