The Italian Implementation of Directive (EU) 2019/882 of the European Union, the Stanca Act, is overseen by the Ministry of Economic Development.

What it includes

  • General consumer hardware systems and computer operating systems for such hardware systems
  • Self-service payment terminals and those intended for the provision of services regulated by this decree
  • Consumer terminal equipment with interactive computing capabilities used for electronic communications services
  • Consumer terminal equipment with interactive computing capabilities used to access audiovisual media services
  • E-readers
  • Electronic communications services, excluding transmission services used for the provision of machine-to-machine services
  • Services providing access to audiovisual media services
  • The following elements relating to passenger transport services by air, bus, rail and waterway, including urban, suburban and regional transport services:
  • Websites
  • Mobile services, including mobile applications
  • Electronic tickets and electronic ticketing services
  • Provision of information relating to transport services, including real-time travel information; as regards information screens, this is limited to interactive screens located in the territory of the Union
  • Interactive self-service terminals located in the territory of the Union, excluding those installed as integral parts of vehicles, aircraft, vessels and rolling stock used for the provision of any part of such passenger transport services
  • Consumer banking services
  • E-books and dedicated software
  • E-commerce services

As an additional point of consideration, regulations also apply to emergency communications with the European emergency number “112”.

Exceptions

  • Time-based media pre-recorded and published before June 28, 2025
  • Office file formats published before June 28, 2025;
  • Online maps and mapping services, where essential information for maps intended for navigation is provided in accessible digital form Third-party content that is neither financed nor developed by the economic operator concerned nor subject to its control
  • Content of websites and mobile applications considered archives in the sense that they contain only content that has not been updated or reworked after 28 June 2025

Fines and penalties

Non-compliance with accessibility regulations may result in fines ranging from 5,000 to 40,000 euros. This range depends on factors such as the degree of non-conformity, the number of non-compliant products or services, and the total number of users affected.

An additional fine of 2,500 to 30,000 euros may be imposed if corrective actions are not taken promptly. Furthermore, entities refusing to cooperate with authorities may face another fine between 2,500 and 30,000 euros.

Failure to implement corrective measures within the specified timeframe could also lead to the withdrawal of non-compliant products from the market.

Reporting

Italy follows the EU-wide mandate for accessibility statements on public sector websites and digital services. These statements are essential for maintaining transparency and accountability.

Economic operators must report non-compliance issues to the Ministry of Economic Development, which in turn informs the European Commission and other Member States.

Accessibility Statement Requirements:

  • Must be detailed, comprehensive, and clearly state the website or mobile application’s compliance with the regulations
  • Presented in an accessible format
  • Prepared using the model accessibility statement from Commission Implementing Decision (EU) 2018/1523
  • Published on the respective website or available with the mobile application

Content of the Accessibility Statement:

  • Explanation of non-accessible content, reasons for the inaccessibility, and accessible alternatives if available
  • Description of and link to a feedback mechanism
  • Link to the redress or complaint procedures under the Equal Status Act 2000 and the Disability Act 2005
