Legea nr. 232/2022, Romania’s digital accessibility regulation is governed by a range of agencies, as shown below.
What it includes
- General-purpose consumer hardware systems and their operating systems
- Consumer terminal equipment with interactive computing capabilities, including:
- Equipment for electronic communications services
- Equipment for accessing audiovisual media services
- E-readers
- Self-service payment terminals, including:
- ATMs
- Ticket machines
- Self-service check-in kiosks
- Interactive self-service terminals providing information (excluding integrated vehicle, aircraft, ship, or rolling stock components)
- Electronic communication services (excluding machine-to-machine transmission services)
- Access services for audiovisual media
- Consumer banking services
- Electronic books and their dedicated software
- E-commerce services
Passenger transport elements affected by the regulation (Applicable to air, rail, sea, and bus transport services, excluding urban, suburban, and regional transport):
- Websites
- Mobile device-integrated services, including mobile apps
- Electronic tickets and ticketing services
- Transport-related information, including:
- Real-time travel updates
- Rail transport information per Annex No. 1 of Regulation (EC) No. 1371/2007.
- Interactive information screens in Romania
- Interactive self-service terminals (excluding integrated vehicle, aircraft, ship, or rolling stock components)
As an additional point of consideration, regulations also apply to emergency communications with the European emergency number “112”.
Exceptions
The law specifies various exclusions and supplementary provisions related to websites and mobile applications. Specifically, exceptions published before June 28, 2025 such as:
- Pre-recorded media content with a temporal dimension
- File formats associated with office activities
- Maps and online mapping services unless essential navigation information is provided in an accessible digital format
- Content belonging to third parties if not financed, developed, or controlled by the economic operator in question
- Archived website and mobile application content if the content is neither updated nor edited after June 28, 2025
In addition, the law is supplemented by:
- Law no. 8/1996 on copyright and related rights, republished with subsequent amendments and additions
- Government Emergency Ordinance no. 112/2018 on the accessibility of websites and mobile applications of public sector bodies, approved by Law no. 90/2019
Fines and penalties
The Romanian regulatory framework enforces penalties to ensure compliance with product and service accessibility standards. Infractions are categorized by type, with escalating consequences for violations.
Fines for producers, importers, distributors and service providers:
- Range from 6,000 to 15,000 lei for non-compliance with the accessibility provisions.
Investigating officers can propose complementary actions, including:
- Withdrawal or recall of non-compliant products.
- Suspension of activities.
- Suspension or withdrawal of approvals necessary for operation during non-compliance.
- Authorities are required to inform the European Commission about applied sanctions and proposed measures, with enforcement carried out by designated bodies.
Reporting
Romania follows the EU-wide mandate for accessibility statements on public sector websites and digital services. These statements are essential for maintaining transparency and accountability.
This statement must be publicly available on their websites and provide clear information on the accessibility status of their digital services, such as whether they meet the required standards or outline existing accessibility issues. The statement should also detail the measures taken to improve accessibility, including any ongoing efforts or plans for remediation. Additionally, the accessibility statement must specify how users can report accessibility problems and request assistance, ensuring that organizations remain accountable and transparent in their commitment to accessible digital experiences.
Regulating bodies
In Romania, the responsibility for overseeing accessibility is divided among several regulatory bodies. The National Authority for Consumer Protection ensures accessibility in consumer products and services. The National Authority for Communications Administration and Regulation oversees accessibility in electronic communication services. The Authority for Digitization of Romania manages digital accessibility across public sector websites and mobile applications. The National Broadcasting Council regulates accessibility in audiovisual media services. Lastly, the Ministry of Transport and Infrastructure supervises accessibility in transportation systems and services, including air, rail, and road networks.
