Slovenia

The Act on accessibility to products and services for the disabled (Zakon o dostopnosti do proizvodov in storitev za invalide), Slovenia’s digital accessibility regulation, is governed by the Market Inspectorate of the Republic of Slovenia and TIRS (Technical Inspection and Regulatory Services).

What it includes

  • Audiovisual media services
  • E-readers
  • Services, including:
  • Electronic communications (excluding machine-to-machine transmission services)
  • Audiovisual media services
  • Passenger transport services (air, bus, and water), covering websites, mobile device-based services, electronic ticket issuing services and travel information screens
  • Consumer banking services
  • E-books
  • Dedicated software
  • E-commerce services
  • Special provisions for urban, suburban, and regional transport services
  • Accessibility requirements for facilities used by disabled individuals, in accordance with building use and construction regulations

Exceptions

The regulation excludes certain types of digital content and services from its scope. Specifically, it does not apply to: pre-recorded timed media content, office file formats, and archival website content published before June 28, 2025; online maps and map services, provided the navigational information is accessible digitally; third-party content that is neither financed nor controlled by the economic entity; and micro-enterprises offering services.

Additionally, the regulation does not cover areas related to rail transport and public railway infrastructure, which are governed by separate EU Commission Regulations. These regulations set technical standards for the accessibility of railway systems, focusing on issues such as identifying accessibility barriers, providing user information, and monitoring accessibility progress across the European railway system.

Fines and penalties

Non-compliance with accessibility regulations can result in various fines depending on the severity of the offense and the type of entity involved. The penalty system is structured as follows:

For legal entities involved as distributors or users of a product:

  • Fines range from 1,200 to 3,000 euros for committing an offense related to distribution or usage
  • A fine of 500 to 5,000 euros for legal persons committing a misdemeanor, with medium- or large-sized companies facing fines of 1,000 to 10,000 euros for offenses such as failing to ensure accessibility to consumer banking services or e-commerce

For individual entrepreneurs or individuals performing activities independently:

  • A fine of 800 to 3,000 euros for offenses related to distribution or usage of a product
  • Fines range from 2,000 to 15,000 euros for offenses committed in relation to manufacturing, importing, or acting as an authorized representative in Slovenia

For responsible persons of legal entities or individual entrepreneurs:

  • Fines from 200 to 400 euros for offenses related to distribution or usage activities
  • A fine of 50 to 250 euros for responsible persons failing to ensure accessibility for specific products or services
  • Fines of 120 to 400 euros for violations of accessibility information or service provision

For offenses related to manufacturing, importing, or authorized representation:

  • A fine of 3,000 to 40,000 euros for a legal entity committing an offense in relation to these activities
  • Fines ranging from 1,200 to 4,000 euros for responsible persons or self-employed individuals involved in similar offenses

This tiered penalty system underlines the importance of ensuring accessibility and compliance with legal requirements, with fines escalating depending on the entity’s role, size, and the severity of the violation.

Reporting

Slovenia follows the EU-wide mandate for accessibility statements on public sector websites and digital services. These statements are essential for maintaining transparency and accountability.

This statement must be publicly available on their websites and provide clear information on the accessibility status of their digital services, such as whether they meet the required standards or outline existing accessibility issues. The statement should also detail the measures taken to improve accessibility, including any ongoing efforts or plans for remediation. Additionally, the accessibility statement must specify how users can report accessibility problems and request assistance, ensuring that organizations remain accountable and transparent in their commitment to accessible digital experiences.

Regulating bodies

In Slovenia, the TIRS (Technical Inspection and Regulatory Services) oversees accessibility compliance for products. First, TIRS evaluates whether a product meets accessibility requirements. If non-compliant, the responsible entity must correct the issues within a set timeframe, which may involve making the product compliant, withdrawing it, or recalling it.

If corrective measures are not taken, TIRS will enforce a market withdrawal within an additional period. All actions align with Slovenian regulations on market control and product conformity. If needed, TIRS will coordinate with international bodies to ensure global compliance.
